Rules of Operation of the Safe Driving Practice Ground

1. General Terms:
1.1. These terms set the rules which apply to the LLC „Baltic Ring 333” Safe Driving Practice Ground (hereinafter called “Practice Ground”) user (hereinafter called “User”) activity during training sessions.
1.2. The User of the Practice Ground is a person who participates in any of the Practice Ground driving courses which take place at the Practice Ground.
1.3. Practice Ground training session - is a training course in driving selected by the User, which is conducted by the Practice Ground Trainer (hereinafter called “Instructor”).

2. User Obligations:
2.1. If the User chooses to use his/her car (hereinafter called “Car”) during the training session, then:
2.1.1. the car should have a valid State Vehicle Test Certificate;
2.1.2. the fuel tank should contain at least 10-15 l of fuel, however depending on the programme duration, there should be enough fuel for a 3-4 hour training session;
2.1.3. the car tyres should not be studded.
2.2. Fully pay for the selected driving course before commencing the first session. If the payment is made by bank transfer, present the bank payment confirmation before the first session;
2.3. Follow all instructions given by the Instructor within the context of the selected training course;
2.4. Prior to training sessions, master the fundamentals of a portable radio set, rules of use of the portable radio set will be introduced by the Instructor;
2.5. While in the car, use safety belts;
2.6. Do not exceed the car speed limit set up by the Instructor while performing a task;
2.7. Do not tailgate, keep at least 1 m distance from the vehicle ahead;
2.8. In the case of any questions or uncertainty in relation to the fulfilment of a task, Users are kindly requested to address their question to the Instructor until the task is completely clear;
2.9. If there are any problems with the continuation of driving, the Instructor must be notified via a portable radio set;
2.10. On revealing problems with your portable radio set operation, inform your Instructor about it without delay;
2.11. During the training sessions treat the equipment being used and the tangible assets available at the Practice Ground with care.

3. User is strictly prohibited to:
3.1. Stay at the Practice Ground while intoxicated;
3.2. Wilfully use the Practice Ground routes without a command word given by the Instructor and his directions for the next task performance;
3.3. Move to the other parts of the Practice Ground without the Instructor’s permission;
3.4. Change direction and the configuration of driving without permission and stop at the Practice Ground without any good reason;
3.5. Never start movement in a specific area on the Practice Ground while another User is performing a task;
3.6. Leave the car without the Instructor's permission in the case of emergency stopping.

4. Responsibilities of the User:
4.1. Full responsibility for the observation of responsibilities and prohibitions, for the fulfilment thereof and the ensuing consequences;
4.2. Civil liability in accordance with the legal regulations applicable in the Republic of Latvia;
4.3. Full responsibility for the availability of the road vehicle owner's third party liability insurance (OCTA) policy and valid State Vehicle Test Certificate for the car which will be used during training;
4.4. The overall mass of the User car must not exceed 3.5 tonnes;
4.5. If the User uses the car that belongs to the Practice Ground, he/she takes full responsibility for using the car (see p. 2.11 and 4.2). The Practice Ground shall be responsible for the car’s technical condition and fuel.

5. Rights of the User:
5.1. Perform the tasks set by the Instructor under a specific training programme;
5.2. Refuse to perform the task, if the User becomes aware or has any doubts that due to certain circumstances he/she will not be able to fulfil the task;
5.3. If a User who attends the “Training course, Traffic Safety Programme” in accordance with LR Cabinet of Ministers Regulation No. 551, becomes aware or has any doubts that due to certain circumstances he/she will not be able to fulfil the task included in the training programme and refuses to fulfil such task, in such circumstances the above-mentioned training course programme is qualified as “not passed”;
5.4. Ask any questions regarding the fulfilment of the training tasks and receive answers from the Instructor to the questions he/she is interested in.

6. Other Provisions:
6.1. 333 shall not assume liability for the personal belongings of the User;
6.2. In the case of a violation of the above-mentioned rules the User gets a verbal warning and, if the User doesn’t follow the warning, the User shall be immediately excluded from participation in the training session without the right to renew it; in this case the tuition fee is not reimbursed;
6.3. Any complaints that may arise during training should be submitted in written form in free format immediately after the end of the training programme;
6.4. Any dispute or disagreements arising between the User and any third party shall be settled by means of negotiations; should the parties fail to reach an agreement, the disputes shall be resolved by the judicial authority in accordance with the procedure established by the legal regulations of the Republic of Latvia;
6.5. Any dispute or disagreement arising between the User and Instructor shall be settled by means of negotiations; should the parties fail to reach an agreement, the Board of the enterprise should be involved to resolve the situation. Should the parties fail to reach an agreement in negotiations with the Board, the disputes shall be resolved by the judicial authority in accordance with the procedure established by the legal regulations of the Republic of Latvia;
6.6. The User has read and understood the 333 “Rules of Operations of the Safe Driving Practice Ground” and commits himself/herself to adhere to them, which is confirmed by his/her signature in the “Rules of Operations of Safe Driving Practice Ground” log.
